Constitution for Sovereign Individuals


Whereas:
The Open Source Constitution for Africa shall serve as the basis for all legitimate forms of governance for those who have voluntarily agreed to these principles of Liberty. The form of governance in this document shall be termed "Open Canton" to reflect the competitive nature of voluntary non-monopoly based governance of defense, security and dispute resolution issues in a society.

Whereas:
Open Canton is more than a label for systems of voluntary defense, security and dispute resolution. The operational terms of Open-Cantons must comply with the following criteria:

Article 1. Individual Self-Ownership is the basis for the Open Canton
Every individual is naturally endowed with the right to his or her own life, personal liberty and private property. In life the individual may find it necessary to voluntarily work with others to preserve his life, liberty, and property and this is the core purpose of the Open Canton.

Article 2. Individuals Right to Create a New Open Canton

Every individual being endowed with the right to voluntary association may choose to form a new Open Canton either by himself / herself or in voluntary association with other individuals.

Article 3. Individuals Right to Choose Their Open Canton

Once formed the Open Canton shall respect the right of voluntary association when its members choose to cancel the services of the Open Canton in favor of another.

Article 4. No Monopoly on Force in a Territory

The Open Canton shall respect free competition from all other Open Cantons providing defense, security and dispute resolution services within its defined territory.

Article 5. Unanimous Consent

The Open Canton shall respect unanimous consent of all its members. All members must sign a detailed contract to join the Open Canton or create a new contract to form a new Canton. Once established in contract or joined by a new member the Canton cannot change the policies, rules or details of the contract without the reauthorization of each member who is willing to be bound to the new contract.

Article 6. Non-Aggression Principle is the Standard for all Open Cantons

The Open Cantons shall itself respect the non-aggression principle, which is defined as: the initiation of force, or fraud upon persons or their property, is inherently illegitimate. This principle is the basis on which the Open Canton bases its legitimate right to protect its members from the use of Force or Fraud by others.

Article 7. Natural Human Rights Guaranteed by all Open Cantons
The Open Canton shall respect the right of every individual to Life, Liberty, and Property. The Open Canton cannot take forceful action or prosecute a person for any action that does not directly violate the Life, Liberty or Property of a member of the Open Canton. This is not to say that the Open Canton cannot enter into voluntary negotiations with an individual or company to either promote or discourage acts which are either stipulated as preferred or unwanted in the Canton’s contract with its members.

Article 8. Presumption of Innocence in Open Cantons

The Open Canton shall in all matters assume the accused aggressor of force or fraud is innocent until proven guilty.

Article 9. Transparency in Operation of the Open Canton

The Open Canton shall maintain transparency in all its dispute resolution cases, including evidence, accusations, final decision, resolution and outcome.

Article 10. Equal Application of Dispute Resolution Decisions for all Open Cantons
The Open Canton shall in all matters of dispute resolution apply its rules and covenants equally regardless of race, gender, or age of the accused aggressor.

Article 11. Inter Open Canton Dispute Resolution
Terms shall be established for the mutually acceptable arbitration of any disputes that arise between the Open Canton and another Open Canton.

Article 12. Direct Representation

The Open Canton must respect the right of its members to their own direct representation. The Canton cannot sign any binding treaty, agreement, or create other obligations for its members. Or enter into an agreement with any organization that does not respect this principle. Every individual has the right to directly represent himself or herself and therefore their unanimous direct and voluntary authorization is required in writing for all contracts to be binding.

Article 13. Right to Exit Canton Contract

All Cantons must respect the right of its members to exit the Canton contract and enter into a contract with a different Open Canton or create a new Open Canton.

Article 14. Neutrality in the Wars of States

The Open Canton shall maintain a neutral stance in all conflicts involving the states, which are outside of its defined territory.

Article 15. Freedom from Force or Fraud

The Open Canton cannot claim any policy that requires involuntary taxes or involuntary fees on its members or the members of another Canton.

Article 16. Homesteading Principle

The Open Canton shall respect the individuals right to homestead any part of nature, by the mixing of his time, energy and effort with that part of nature to alter its state and produce from his life and liberty the product of personal property.

Article 17. Monetary and Financial Choice

The Open Canton as in all maters must respect the right of all individuals to choose their own type of currency, financial system, and engage in free trade based on mutual consent.
